FREQUENTLY ASKED QUESTIONS
Q: Do I have to sign this waiver?
A: Yes. By renting equipment from Chromaera Visuals, you are required to sign this waiver as part of the rental agreement before we release any equipment to you.
Q: What does "gross negligence" mean?
A: Gross negligence means extreme carelessness or intentional wrongdoing—for example, operating equipment you know is broken, ignoring obvious safety warnings, or leaving equipment unsecured in extreme conditions. Ordinary negligence (making a mistake) is covered by this waiver; gross negligence is not.
Q: If I buy the Damage Waiver, does this waiver still apply?
A: Yes. The Damage Waiver only protects you from financial charges for accidental equipment damage. This liability waiver still applies to personal injury, death, and third-party claims.
Q: What if I'm injured by the equipment's fault, not mine?
A: If equipment fails due to a defect we knew about and didn't disclose, this waiver doesn't apply. However, if equipment suddenly fails during normal use, the waiver does apply. That's why we strongly recommend getting your own equipment insurance.
Q: Am I liable if someone else (my crew member) gets injured?
A: Yes. You are responsible for ensuring your crew understands the risks and follows safety procedures. If someone is injured because of equipment in your possession, you are liable.
Q: Does this waiver cover theft?
A: No. This waiver does not protect you from liability for stolen equipment. The Damage Waiver also does not cover theft. Only your own equipment insurance covers theft or loss.
Q: What if I disagree with this waiver?
A: You are not required to rent equipment. If you have concerns about this waiver or the risks involved, you may decline the rental. We recommend consulting with an attorney if you have legal questions.
